1. What data is collected

We collect personal data through two forms on this website, and automatically through analytics and advertising tools.

We do not use a Meta Pixel or any live chat tool. We do not collect payment information through this website.

2. Why the data is collected and the lawful basis

Form submissions are collected to respond to enquiries and provide the service you have requested. The lawful basis is legitimate interests (responding to a pre-contract enquiry), and in some cases the steps necessary to enter into a contract at your request. We will not use your contact details for marketing purposes without a separate basis for doing so.

Analytics and advertising tracking data is collected to understand how the website is used and to measure the performance of paid advertising campaigns. The lawful basis for this processing is consent. Under UK GDPR, non-essential cookies, including those placed by Google Analytics and Google Ads, require your prior consent.

Outstanding item: A cookie consent mechanism has not yet been implemented on this website. This is a legal requirement before analytics and advertising tracking tools can operate with a compliant basis under UK GDPR. This will be addressed before full site launch.

3. How the data is used

Form submission data is used solely to follow up on your enquiry. If you submit an audit request, we will review the information provided and reply to the email address you gave us within two working days. If you submit a general contact message, we will reply to your enquiry.

Analytics data is reviewed in aggregate to understand site performance, for example which pages are visited most or where visitors arrive from. It is not used to identify individuals personally.

Advertising tracking data (conversion events through Google Ads) is used to measure whether our own paid advertising is effective. This data is not used to retarget visitors to this website unless a separate remarketing configuration is enabled, which is not currently in place.

4. Who the data is shared with

Our form processing provider. Form submissions are processed and stored by a third-party form handling service. At the time this policy was last updated, the specific provider is pending confirmation (either Netlify Forms or Formspree). This policy will be updated once confirmed. Both are established services with their own privacy documentation, and both process data under their respective terms.

Google. Google Analytics and Google Ads process data in accordance with Google's own privacy policy. Peak Digital Marketing Ltd does not control how Google uses data collected through these tools beyond the configuration applied in the relevant accounts.

We do not sell personal data to third parties and do not share it with any other organisations except as described above or where required by law.

5. Cookies

This website uses cookies placed by Google Analytics and Google Ads. These are non-essential cookies used for analytics and advertising performance measurement. Under UK GDPR, non-essential cookies require your consent before being set.

We do not use any essential or strictly necessary cookies that require no consent.

Outstanding item: A cookie consent banner or equivalent mechanism is required before this website collects analytics or advertising data from visitors. This will be implemented prior to full launch and this section will be updated to reflect how consent is collected and managed.

6. How long data is kept

Form submission data (enquiries and contact messages) is retained for 12 months from the date of submission. If a client relationship develops, data relevant to that engagement is kept for 6 years from the end of the engagement, in line with standard business record-keeping practice under UK law. After these periods, data is deleted.

Analytics data held by Google is subject to Google's own retention settings and policies.

7. Your rights

Under UK GDPR and the Data Protection Act 2018, you have the following rights in relation to your personal data:

  • Right of access: you can request a copy of the personal data we hold about you.
  • Right to rectification: you can ask us to correct inaccurate data.
  • Right to erasure: you can ask us to delete your personal data in certain circumstances.
  • Right to restriction: you can ask us to limit how we use your data while a query is resolved.
  • Right to object: you can object to processing based on legitimate interests.
  • Right to withdraw consent: where processing is based on consent (for example, analytics cookies), you can withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing before the withdrawal.
  • Right to complain to the ICO: if you are not satisfied with how we handle a data request, you have the right to lodge a complaint with the Information Commissioner's Office at ico.org.uk.

8. How to exercise your rights

To exercise any of the rights above, or to ask a question about how your personal data is used, email us at hello@peakdigitalmarketing.co.uk.

We will respond within one calendar month of receiving your request, as required under UK GDPR. In complex cases, we may extend this by a further two months and will notify you if that is the case.

9. Changes to this policy

We may update this privacy policy from time to time, for example to reflect changes to the tools we use or to comply with updated legal requirements. The date at the top of this page will be updated whenever a material change is made. We recommend checking this page periodically if you have previously submitted your details through this site.
